South Australian woman accused of unlawful sex with ex-husband - The tables are turned but will it be enough?

A WOMAN accused of unlawfully performing oral sex on her ex-husband, has no case to answer, the Adelaide Magistrates Court has heard.

The woman, 49, is charged with engaging in sexual intercourse without consent in August 2011 at an address on the Eyre Peninsula.

The complainant said he was awoken by his ex-wife performing fellatio on him.

She appeared in the court on Friday when her lawyer said she had no case to answer, noting it involved the woman’s word against the complainant's. The case was adjourned until September 6.

It's amazing isn't it? I find it really intriguing when the tables are turned in these sorts of cases. Usually, it's the blokes who are accused of rape and sexual abuse etc etc, and the woman is totally believed.. even if she is lying.

I find it interesting that the lawyer says "It's the woman's word against the complainants. Duh ... well of course, it is. The lawyer makes it sound as is this is something incredible. What bullshit, it's usually the guys who have to face some woman who's lying her head off because she's now in too deep and has to continue her lie.

If the court finds there's no case to answer then you'll here more about it on here. I'm sick of blokes taking the rap for woman who have no conscience and have sex ... then regret it later and take legal action to save face. Tough luck.

If the woman is performing fellatio on him and he's asleep, in my books that could be cause for sexual assault (as there is no permission), just as as if a guy starts doing the same to a woman when she's asleep (Again, there is no permission). The dynamics are of course in the relationship. In a healthy loving relationship, this could be considered exciting ( to wake up in pleasure ), but in an unhealthy relationship, this could be used as fodder to instigate sexual assault cases. Food for thought.
